Terms of Service

Drawing America is a community based on creativity and respect. Our goal is to foster a supportive, honest, and caring environment where members can take classes and share feedback with one another.

These Terms of Service are an agreement between you and Drawing New York LLC, doing business as Drawing America and Drawing New York ("we," "us," or "our"). They apply to the drawingamerica.com website, our online courses, live online classes, online community, and Drawing New York in-person classes (together, the "Service"). By creating an account, making a purchase, or using the Service, you agree to these Terms and to our Privacy Policy.

Eligibility

• You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the permission and supervision of a parent or guardian, who agrees to these Terms on your behalf.
• Figure drawing sessions with nude models are open only to students 18 and older.

Community Guidelines

• Hate speech of any kind will result in the immediate removal of the offending member.
• Profanity is not tolerated and will result in a warning. Repeated violations may lead to removal from the community.
• Lead with kindness and curiosity when commenting on other members' work.
• Copyrighted materials belonging to other artists must include proper citation and a link to the original work. Links should direct users to the original artwork on the artist's website or Instagram account.
• Drawing America does not guarantee the safety of messaging, conducting business, or meeting other members through the site. Any interaction with other members is at your own risk.
• Promoting competing schools, services, or events may result in the removal of posts.
• We may remove any content, or suspend or remove any member, that violates these guidelines.

In-Person Classes

• Models must be treated with respect at all times. Photographing or recording models is not permitted.
• Please follow the instructions of the instructor and monitor, and the rules of the venue.
• We may remove anyone from a class whose conduct is disruptive or inappropriate, without a refund.

Your Artwork

• We do not claim any copyright or ownership of the artwork created by our members or students.
• When you post artwork, homework, or comments in the community or a class group, you allow us to display it to the members of that community or group so the Service can work.
• We will not share your artwork on social media or in our marketing without asking your permission first.
• AI is never used on students' artwork.

Class Recordings

• Live online classes may be recorded. Recordings may be shared with enrolled students and may be edited and offered as courses.
• If you would rather not appear in a recording, you may turn off your camera and microphone, or contact us before class.

Payments & Refunds

• Prices are listed in U.S. dollars. Payment is due at the time of purchase. We accept payment through our checkout, including PayPal, Klarna, and Afterpay.
• Recorded courses and online content: refunds are generally not provided once content has been purchased.
• Live online classes: refund requests are reviewed on a case-by-case basis. We strive to accommodate our members whenever possible.
• In-person classes: cancel at least 48 hours before the class begins for a refund. Cancellations made less than 48 hours before class are not eligible for a refund, because we limit registration to hold your spot.
• Payment processing fees are non-refundable. Any refund is issued minus the original processing fee.
• Refunds are returned to the original payment method. For purchases made with Klarna or Afterpay, refunds are handled according to that provider's terms.

Subscriptions

• Monthly subscriptions renew automatically each month and are charged to your payment method on file until you cancel.
• You can cancel at any time from your account or by emailing [email protected]. Your access continues until the end of the month you have already paid for.
• We do not provide refunds for partial months.
• If we change the price of a subscription, we will notify you before the new price takes effect.

Course Access

• When you purchase a recorded course, you have access to it for as long as Drawing America offers that course on our platform.
• Your access is personal to you and for your own learning only.

Accounts

• You are responsible for keeping your login information secure and for activity on your account.
• Sharing accounts, usernames, or passwords is strictly prohibited and may result in the termination of access without a refund.

Intellectual Property

• All written, graphic, video, and other materials presented by Drawing America are protected by copyright.
• These materials may not be copied, shared, distributed, or sold without prior written permission.
• Downloading, screen-recording, or otherwise capturing course videos or live classes is prohibited, including with browser extensions or other software.
• Violations of our copyright policy may result in legal action and the immediate termination of access to the site without a refund.

Termination

We may suspend or end your access to the Service if you violate these Terms. You may stop using the Service at any time.

Disclaimers

The Service is provided "as is" and "as available." We do not guarantee that the Service will be uninterrupted or error-free, or that you will achieve any particular result from a course or class.

Limitation of Liability

To the fullest extent permitted by law, Drawing New York LLC will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim related to the Service will not exceed the amount you paid us in the 12 months before the claim arose.

Indemnification

You agree to hold Drawing New York LLC harmless from any claims arising from your violation of these Terms or from content you post.

Governing Law

These Terms are governed by the laws of the State of New York. Any dispute will be resolved in the state or federal courts located in New York County, New York.

Changes to These Terms

Drawing America reserves the right to modify or update these Terms of Service at any time. Changes take effect when posted on this page, and the "Last updated" date above will be revised. Continued use of the Service constitutes acceptance of the updated Terms.
